Welcome to MEP Evals, LLC. By accessing our website, subscribing to our monthly testing portal, and administering evaluations (collectively, the “Services”), you (“Client,” “you,” “your”) agree to be bound by these Terms and Conditions (“Terms”).

If you are entering into these Terms on behalf of an MEP firm, consulting group, or other business entity, you represent that you have the authority to bind such entity to these Terms.

1. Description of Services

We provide a proprietary, web-based technical assessment platform designed to evaluate the HVAC engineering proficiency of job candidates. Services are delivered through a hybrid platform utilizing WordPress, Paid Memberships Pro, and our integrated testing engine, FlexiQuiz.

2. Accounts, Subscriptions, and Payments

Monthly/Annual Subscriptions

  • Clients subscribing to a recurring plan (customized tiers) are billed annually in advance on a recurring cycle via Stripe.

  • Cancellation: You may cancel your subscription at any time through your Client Portal. Access to the subscription features will continue until the end of your current billing period. No prorated refunds are provided for partial months.

  • Volume Limits: Subscription tiers are subject to a maximum annual testing volume. Upon using all of your allocated evaluations, access to the administration page will be disabled until the start of your next billing cycle. Unused test allocations do not roll over to the next billing cycle. You may contact us to upgrade your subscription as needed.

3. Permitted Use and Proprietary Test Questions

A. Intellectual Property

All test questions, technical scenarios, diagrams, and software interfaces are the exclusive, proprietary intellectual property of MEP Evals, LLC.

B. Use Restrictions

You and your candidates are strictly prohibited from:

  • Copying, screenshotting, recording, or duplicating any test questions or answer options.

  • Sharing, publishing, or distributing test questions on public job boards, forums, or review sites (e.g., Glassdoor, Linked-In, Reddit).

  • Attempting to reverse-engineer, scrape, or extract our test database.

  • Penalty: Any breach of this section will result in immediate termination of your client account without refund, a permanent block on your domain, and we reserve the right to seek damages for intellectual property infringement.

4. Candidate Integrity & Proctoring

While our platform implements automated anti-cheating measures (including tab-switch detection, browser tracking, cut/copy/paste/ disabling, and time limits), we do not guarantee that candidate results are entirely free from unassisted help. The automated scorecards are intended as an evaluation aid, not a foolproof certification of absolute honesty.

5. Professional Liability Disclaimer (IMPORTANT)

MEP Evals, LLC provides technical competency assessments only. We are not an engineering consultancy, and we do not certify or license engineers.

  • No Hiring Guarantees: We make no representations or guarantees regarding whether a candidate who passes our assessments will perform satisfactorily if hired.

  • Engineering Accountability: The ultimate responsibility for reviewing, vetting, hiring, and supervising any candidate rests solely with your firm.

  • No Liability for Design Work: MEP Evals, LLC shall not be held liable under any circumstances for any professional errors, omissions, design flaws, load calculation mistakes, construction delays, equipment failures, change orders, or safety issues caused by a candidate or employee you evaluated using our platform.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MEP Evals, LLC, its founders, or its affiliates be liable for any indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, lost billable hours, loss of project revenue, project budget overruns, or damage to firm reputation) arising out of or in connection with the use of our services.

Our total aggregate liability under these Terms shall not exceed the total amount actually paid by you to us in the three (3) months preceding the event giving rise to the claim.

7. Termination of Service

We reserve the right, at our sole discretion, to suspend or terminate your access to the Client Portal or deactivate unused tokens if we suspect a violation of these Terms, non-payment, or any fraudulent activity, without prior notice or liability.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Sheridan County, Wyoming.
